{"id":8788,"date":"2023-08-04T15:05:07","date_gmt":"2023-08-04T19:05:07","guid":{"rendered":"https:\/\/www.infotetquebec.com\/for-temporary-foreign-worker-program-applicants-impacted-by-hazardous-weather-conditions-2\/"},"modified":"2023-08-23T15:12:41","modified_gmt":"2023-08-23T19:12:41","slug":"for-temporary-foreign-worker-program-applicants-impacted-by-hazardous-weather-conditions-2","status":"publish","type":"post","link":"https:\/\/www.infotetquebec.com\/en\/for-temporary-foreign-worker-program-applicants-impacted-by-hazardous-weather-conditions-2\/","title":{"rendered":"For Temporary Foreign Worker Program applicants impacted by hazardous weather conditions"},"content":{"rendered":"<p style=\"font-weight: 400;\">Hello,<\/p>\n<p style=\"font-weight: 400;\">You are receiving this message because you are taking part in the Temporary Foreign Worker Program (TFWP) and you may have been impacted by hazardous weather conditions, including the wildfires.<\/p>\n<p style=\"font-weight: 400;\">Under these circumstances, we would like to provide you with information on the Program and remind you that you must continue to meet your <a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/employer-compliance.html\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/employer-compliance.html&amp;source=gmail&amp;ust=1691181296958000&amp;usg=AOvVaw3bT65_TPhmCnyK_xWH0a7x\">obligations under the TFWP<\/a>, including:<\/p>\n<ul style=\"font-weight: 400;\">\n<li>follow the local evacuation procedures (e.g., know evacuation sites, maintaining contact plan with the temporary foreign workers (TFWs), be ready for an evacuation as per provincial or territorial guidelines);<\/li>\n<li>contact your <a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/processing-centres.html\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/processing-centres.html&amp;source=gmail&amp;ust=1691181296958000&amp;usg=AOvVaw3U-7x_l352icI20oXc8W9X\">regional processing centre<\/a> by email to report any unreachable TFWs.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\">If your business cannot operate and you need to lay off TFWs, you must issue a record of employment (ROE) to allow the TFWs to apply for Employment Insurance benefits. Of note, Seasonal Agricultural Worker Program (SAWP) contracts \u2014 which require annual negotiations with participating source nations \u2014 also have minimum hours of work and compensation clauses that may exceed 30 hours a week.<\/p>\n<p style=\"font-weight: 400;\">It is also worth noting that TFWs are subject to provincial and, when applicable, federal employment regulations. Employers can legally layoff workers should a work stoppage make it impossible for the employer to fulfill their obligations under the Labour Market Impact Assessment (LMIA).
