reminders on existing recruitment and advertising requirements for both the Low\u2011wage Stream and the High\u2011wage Stream.<\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\">Separate guidance will be issued for agricultural stakeholders to address recruitment and advertising requirements specific to the Seasonal Agricultural Worker Program (SAWP) and the Agricultural Stream, where distinct rules apply.<\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><strong><u data-ogsc=\"\">New Recruitment Requirements for Low\u2011Wage Positions (Effective April 1, 2026)<\/u><\/strong><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\">To\u00a0continue protecting\u00a0the Canadian\u00a0labour\u00a0market and reinforce the priority hiring of Canadians and permanent residents, the TFW Program is introducing two new recruitment requirements for low\u2011wage positions.<\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\">These requirements apply to\u00a0Labour\u00a0Market Impact Assessment (LMIA) applications\u00a0<b data-ogsc=\"\">received on or after April 1, 2026<\/b>.<\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\"><b data-ogsc=\"\">Employers must:<\/b><\/span><\/p>\n<ol start=\"1\" data-editing-info=\"{&quot;applyListStyleFromLevel&quot;:true}\">\n<li data-ogsc=\"rgb(0, 0, 0)\">\n<p role=\"presentation\"><b data-ogsc=\"\">Advertise the position for at least 8 consecutive weeks<\/b><\/p>\n<ul data-editing-info=\"{&quot;applyListStyleFromLevel&quot;:true}\">\n<li data-ogsc=\"rgb(0, 0, 0)\">\n<p role=\"presentation\">Advertising must take place\u00a0<b data-ogsc=\"\">within the 3 months prior<\/b>\u00a0to\u00a0submitting\u00a0an LMIA application.<\/p>\n<\/li>\n<li data-ogsc=\"rgb(0, 0, 0)\">\n<p role=\"presentation\">The full advertising period must be completed\u00a0<b data-ogsc=\"\">before<\/b>\u00a0the LMIA is\u00a0submitted.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-ogsc=\"rgb(0, 0, 0)\">\n<p role=\"presentation\"><b data-ogsc=\"\">Demonstrate targeted recruitment efforts to reach youth (ages 15\u201330)<\/b><\/p>\n<ul data-editing-info=\"{&quot;applyListStyleFromLevel&quot;:true}\">\n<li data-ogsc=\"rgb(0, 0, 0)\">\n<p role=\"presentation\">Employers must show that reasonable efforts were made to encourage\u00a0youth\u00a0to apply and be hired\u00a0<b data-ogsc=\"\">before seeking a temporary foreign worker<\/b>.\u00a0This can include posting on\u00a0<span data-ogsc=\"rgb(12, 100, 192)\"><a id=\"OWAcf9329f5-3aaf-64c8-89dc-ab7e5deb6740\" class=\"x_OWAAutoLink\" title=\"https:\/\/www.jobbank.gc.ca\/home\" href=\"https:\/\/www.jobbank.gc.ca\/home\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"13\" data-ogsc=\"rgb(12, 100, 192)\"><u data-ogsc=\"\">Job Bank (youth section)<\/u><\/a><\/span><a id=\"OWAcf9329f5-3aaf-64c8-89dc-ab7e5deb6740\" class=\"x_OWAAutoLink\" existing recruitment requirements.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\"><u data-ogsc=\"\">General Recruitment Requirements \u2013 Key Reminders<\/u><\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\">Before hiring a temporary foreign worker, employers must make\u00a0<b data-ogsc=\"\">reasonable\u00a0efforts<\/b>\u00a0to hire or train\u00a0<b data-ogsc=\"\">Canadians and permanent residents<\/b>.<\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span and permanent residents.<\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\">Employers must review and consider\u00a0<b data-ogsc=\"\">all<\/b>\u00a0applications received from Canadians and permanent residents, regardless of whether they are\u00a0submitted\u00a0through Job Bank or other recruitment methods used for the position.<\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\">Employers\u00a0are required to\u00a0<\/span><span data-ogsc=\"rgb(12, 100, 192)\"><a id=\"OWA25947c6b-9f09-92be-8482-9ae9b0d7561b\" class=\"x_OWAAutoLink\" title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage\/low\/requirements.html#:~:text=Recruitment%20documentation%20retention\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage\/low\/requirements.html#:~:text=Recruitment%20documentation%20retention\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"18\" data-ogsc=\"rgb(12, 100, 192)\"><u data-ogsc=\"\">retain recruitment and advertising records<\/u><\/a><\/span><span data-ogsc=\"rgb(0, 0, 0)\">\u00a0for a minimum of 6 years\u00a0and\u00a0may be requested\u00a0by\u00a0Service Canada as part of LMIA assessments or compliance activities.\u00a0In Quebec, eligible employers for the\u00a0<i data-ogsc=\"\">traitement simplifi\u00e9<\/i>\u00a0must keep recruitment and advertising records even if they are not required to submit these documents at the time of submission.<\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\">All required advertising must\u00a0be completed\u00a0within\u00a0the\u00a03-month\u00a0period\u00a0before\u00a0submitting\u00a0an LMIA, with at least one recruitment activity ongoing until a positive or negative LMIA decision is issued.<\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\">The job offer should be consistent with the reasonable workforce needs of the business, and the content in the advertisement should be in line with the position being\u00a0sought\u00a0through the TFW Program.<\/span><\/p>\n<p><\/p>\n<p class=\"x_elementToProof\"><span data-ogsc=\"rgb(0, 0, 0)\">Employers in Quebec, wishing to hire temporary foreign workers must also consult the\u00a0<\/span><span data-ogsc=\"rgb(12, 100, 192)\"><a id=\"OWA944ae40a-48f6-120a-0649-0e40f35ef956\" class=\"x_OWAAutoLink\"
