Agriculture sector of the Temporary Foreign Worker Program (TFW Program).<\/p>\n<p><b>Primary Agriculture<\/b><\/p>\n<p>Subject to certain\u00a0<u><a title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural.html\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"15\">criteria<\/a><\/u>,\u00a0four streams are available to employers to hire temporary foreign workers in the\u00a0<u><a title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural.html#:~:text=85101%20and%2085103-,Hire%20a%20temporary%20foreign%20agricultural%20worker,-You%20can%20hire\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural.html#:~:text=85101%20and%2085103-,Hire%20a%20temporary%20foreign%20agricultural%20worker,-You%20can%20hire\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"16\">Primary agriculture sector<\/a><\/u>.<\/p>\n<p>Employers should regularly consult the TFW Program\u2019s website to ensure that they are fully aware of their\u00a0<u><a title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/employer-compliance.html\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/employer-compliance.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"17\">compliance obligations<\/a><\/u>\u00a0and the requirements applicable for each stream:<\/p>\n<ul type=\"disc\">\n<li><u><a title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural\/seasonal-agricultural\/requirements.html\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural\/seasonal-agricultural\/requirements.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"18\">Seasonal Agricultural Worker Program<\/a><\/u>\u00a0(SAWP)<\/li>\n<li><u><a title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural\/agricultural\/requirements.html\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural\/agricultural\/requirements.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"19\">Agricultural Stream<\/a><\/u><\/li>\n<li><u><a title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage\/low\/requirements.html\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage\/low\/requirements.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"20\">Low-wage positions in Primary Agriculture<\/a><\/u><\/li>\n<li><u><a title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage\/high\/requirements.html\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage\/high\/requirements.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"21\">High-wage positions in Primary Agriculture<\/a><\/u><\/li>\n<\/ul>\n<p><b>Prevailing wages in the SAWP and the Agricultural streams<\/b><\/p>\n<p>Employers must provide temporary foreign workers with the same wages and benefits as those provided to Canadian and permanent resident workers in the same occupation.<\/p>\n<p><u>At all times during the employment period<\/u>, employers\u00a0<u>are responsible for\u00a0adjusting<\/u>\u00a0the worker\u2019s wage to ensure that it meets or exceeds the applicable federal\/provincial\/territorial minimum wage rates in effect or the National Commodity List (NCL) tables\u00a0wage\u00a0rates, whichever is higher.<\/p>\n<ul type=\"disc\">\n<li><u><a title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural\/seasonal-agricultural\/working-conditions.html\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural\/seasonal-agricultural\/working-conditions.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"22\">Seasonal Agricultural Worker Program &#8211; SAWP<\/a><\/u><\/li>\n<li><u><a title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural\/agricultural\/working-conditions.html\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural\/agricultural\/working-conditions.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"23\">Agricultural Stream<\/a><\/u><\/li>\n<\/ul>\n<p>The next update to the NCL wage tables is scheduled for\u00a0December 31, 2025. This update will include adjustments based on the Consumer Price Index.\u00a0Accordingly, wages will increase by\u00a02.00% unless the federal\/provincial\/territorial minimum wage is higher.<\/p>\n<p>Throughout the year 2026, based on federal\/provincial\/territorial changes to minimum wage, other updates will be made to the NCL tables. The TFW Program website will be continually updated to reflect these changes, and employers are encouraged to consult it regularly.<\/p>\n<p><b>Note<\/b>: Employers hiring workers for positions in Qu\u00e9bec under the SAWP or the Agricultural\u00a0stream must refer to\u00a0<u><a title=\"https:\/\/www.quebec.ca\/entreprises-et-travailleurs-autonomes\/administrer-gerer\/embauche-gestion-personnel\/recruter\/embaucher-immigrant\/embaucher-travailleur-etranger-temporaire\/embaucher-travailleur-agricole\" href=\"https:\/\/www.quebec.ca\/entreprises-et-travailleurs-autonomes\/administrer-gerer\/embauche-gestion-personnel\/recruter\/embaucher-immigrant\/embaucher-travailleur-etranger-temporaire\/embaucher-travailleur-agricole\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"24\">the\u00a0salary established<\/a><\/u>\u00a0(French only) by the Minist\u00e8re de l&#8217;Immigration, de la Francisation\u00a0et de l&#8217;Int\u00e9gration\u00a0(MIFI), rather than the NCL.<\/p>\n<p><b>SAWP contract for 2026<\/b><\/p>\n<p>The TFW Program SAWP Stream has a standard, non-modifiable contract that is reviewed annually. The SAWP contract does\u00a0not need to be included with the employer\u2019s\u00a0Labour\u00a0Market Impact Assessment (LMIA) application. However, employers\u00a0are required to\u00a0keep a copy of the contract signed by both the employer and the worker on file\u00a0in the event of\u00a0an inspection. Workers must sign the copy of this contract on or before the first day of work, and employers must provide copies of the contract to the workers in English or French, and Spanish (when applicable). The\u00a0<u><a title=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural\/seasonal-agricultural\/requirements.html#sawp-contract\" href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural\/seasonal-agricultural\/requirements.html#sawp-contract\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"25\">SAWP contract<\/a><\/u>\u00a0for 2026\u00a0will be available on the TFW Program\u2019s website in early January\u00a02026.<\/p>\n<p><b>End of the temporary suspension of the minimum advertising requirements<\/b><\/p>\n<p>As\u00a0indicated\u00a0in the communiqu\u00e9 sent on December 4\u00a0and earlier this summer,\u00a0effective January 1, 2026, employers\u00a0submitting LMIA applications for primary agriculture positions\u00a0will be\u00a0required\u00a0to meet all advertising requirements, including providing proof of recruitment efforts to hire Canadians and permanent residents.<\/p>\n<p class=\"x_elementToProof\">You are encouraged to share this communication throughout your respective networks, and with any colleagues or peers who may need to be aware of this information.
