The law applies to everyone in Canada, regardless of nationality or immigration status.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This includes:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Driving after consuming alcohol or drugs (legal or illegal);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Being inside a vehicle with access to the keys;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sleeping in a vehicle while intoxicated, even if not driving.<\/span><\/li>\n<\/ul>\n<p><b>Important<\/b><span style=\"font-weight: 400;\">: The concept of <\/span><i><span style=\"font-weight: 400;\">care and control<\/span><\/i><span style=\"font-weight: 400;\"> means that if a person is able to put the vehicle in motion, even accidentally, they may be charged.<\/span><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-inner-column elementor-element 400;\">Sleeping in a vehicle after consuming alcohol or drugs is often seen as a safe alternative, but in Canada, it can still result in criminal charges.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Even if:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The vehicle is parked;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The engine is off;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You are in the back seat;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The vehicle is not operational;<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">You may still be charged with <\/span><i><span style=\"font-weight: 400;\">care and control<\/span><\/i><span style=\"font-weight: 400;\">, carrying the same consequences as impaired driving.<\/span><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6e28134 elementor-widget elementor-widget-heading\" data-id=\"6e28134\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mandatory alcohol and drug education programs;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Possible ignition interlock device;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In serious cases, imprisonment.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">For TFWs, consequences can be <\/span><b>immediate and severe<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Loss or non-renewal of work permit;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Loss of legal status;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Criminal inadmissibility;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Removal from Canada;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Future difficulties obtaining visas or permanent residence.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Every case is different. A charge does not automatically mean removal from Canada. With legal advice, it may be possible to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Challenge the legality of the arrest or evidence;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Negotiate reduced or alternative charges;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Present mitigating circumstances;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Access alternative justice programs;<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Explore available immigration options.<\/span><span style=\"font-weight: 400;\"><br
