These new measures will be in effect beginning September 26, 2024, until further notice.<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<p><span lang=\"en-US\">Please note that <a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"35\">the TFW Program website<\/a> will be updated on September 26, 2024, to reflect all changes coming into effect.<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<p><b><span lang=\"en-CA\">The following changes will apply to LMIA applications received on or after September 26, 2024:<\/span><\/b><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<ul type=\"disc\">\n<li><span lang=\"en-CA\">Refusal to process LMIA applications for low-wage positions<\/span><span lang=\"en-CA\">\u00a0<\/span><\/li>\n<\/ul>\n<p>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-CA\">LMIA applications for positions where the workplace is located in any of the Canadian\u00a0<\/span><span lang=\"en-US\">Census Metropolitan Areas\u00a0<\/span><span lang=\"en-CA\">(CMA) with an unemployment rate of 6% or more, and where the wage offered is lower than the\u00a0<\/span><a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"36\"><span lang=\"en-CA\">median hourly wage<\/span><\/a><span lang=\"en-CA\">\u00a0in effect in the province or territory, will not be processed and fees for these applications will not be collected.<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<p>o\u00a0\u00a0\u00a0\u00a0<b><span lang=\"en-CA\">This measure applies to both seasonal (270 days or less) and non-seasonal positions.<\/span><\/b><\/p>\n<p>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-US\">Positions in the\u00a0<\/span><a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural.html#:~:text=to%20primary%20agriculture.-,Primary%20agriculture,-Primary%20agriculture%20is\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"37\"><span lang=\"en-CA\">Primary Agriculture stream<\/span><\/a><span lang=\"en-CA\">,\u00a0<\/span><span lang=\"en-US\">and occupations in\u00a0<\/span><span lang=\"en-CA\">food manufacturing (NAICS 311), construction (NAICS 23), and healthcare (NAICS 622 and 623) sectors will not be subject to this refusal to process, whether the position is seasonal or not.<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<ul type=\"disc\">\n<li><span lang=\"en-CA\">Cap on the proportion of low-wage positions<\/span><span lang=\"en-CA\">\u00a0<\/span><\/li>\n<\/ul>\n<p><span lang=\"en-CA\">\u00a0<\/span>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-CA\">Employers will be allowed to hire temporary foreign workers in low-wage positions under the TFW Program for up to a maximum of 10% of their total workforce, in a\u00a0<\/span><span lang=\"en-US\">specific\u00a0<\/span><span lang=\"en-CA\">work location. This is a further reduction from the 20% cap announced in March 2024.<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<p>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-CA\">This measure will also apply to low-wage positions eligible for \u201csimplified processing\u201d in the province of Qu\u00e9bec.<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<p>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-US\">Exceptions will be made: the cap on the proportion of low-wage positions, at a given worksite, will be of 20% for occupations in\u00a0<\/span><span lang=\"en-CA\">food manufacturing (NAICS 311), construction (NAICS 23), and healthcare (NAICS 622 and 623) sectors<\/span><span lang=\"en-US\">.\u00a0<\/span><span lang=\"en-CA\">This is a further reduction from the 30% cap announced in March 2024 for positions in the construction and healthcare sectors.<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<p>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-CA\">As a reminder,\u00a0<\/span><span lang=\"en-US\">low-wage positions\u00a0<\/span><span lang=\"en-US\">in the\u00a0<\/span><span lang=\"en-US\">Primary Agriculture\u00a0<\/span><span lang=\"en-CA\">stream,\u00a0<\/span><span lang=\"en-US\">seasonal positions of less than 270 days<\/span><span lang=\"en-CA\">, and highly mobile or truly temporary positions (120 calendar days or less) remain exempt from this measure.<\/span><\/p>\n<ul type=\"disc\">\n<li><span lang=\"en-CA\">Reduction of the maximum duration of employment for low-wage positions<\/span><span lang=\"en-CA\">\u00a0<\/span><\/li>\n<\/ul>\n<p>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-US\">The maximum duration for the period of employment for workers hired in\u00a0<\/span><a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage\/low.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"38\"><span lang=\"en-US\">low-wage positions<\/span><\/a>\u00a0<span lang=\"en-US\">will be reduced from two years to one year.<\/span><span lang=\"en-CA\">\u00a0<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<p>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-CA\">This measure will also apply to low-wage positions eligible for \u201csimplified processing\u201d in the province of Qu\u00e9bec.<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<p>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-US\">Low-wage\u00a0<\/span><span lang=\"en-CA\">positions in\u00a0<\/span><span lang=\"en-US\">the\u00a0<\/span><span lang=\"en-US\">Primary Agriculture\u00a0<\/span><span lang=\"en-CA\">Stream\u00a0will be exempt from this measure.<\/span><span lang=\"en-CA\">\u00a0<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<ul type=\"disc\">\n<li><span lang=\"en-CA\">\u201cDual-intent\u201d LMIA applications in support of Permanent Residency under the TFW Program<\/span><span lang=\"en-CA\">\u00a0<\/span><\/li>\n<\/ul>\n<p>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-CA\">As announced on\u00a0<\/span><a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/news\/2024\/08\/minister-boissonnault-announces-new-measures-to-address-fraud-in-canadas-temporary-foreign-worker-program.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"39\"><span lang=\"en-CA\">August 6, 2024<\/span><\/a><span lang=\"en-CA\">, the TFW Program requirements for \u201cdual-intent\u201d LMIA applications in support of permanent residency will be harmonized with those\u00a0<\/span><span lang=\"en-US\">currently in place for\u00a0<\/span><a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage\/low\/requirements.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"40\"><span lang=\"en-CA\">low-wage<\/span><\/a><span lang=\"en-CA\">\u00a0and\u00a0<\/span><a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/median-wage\/high\/requirements.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"41\"><span lang=\"en-CA\">high-wage<\/span><\/a>\u00a0<span lang=\"en-CA\">positions, and\u00a0<\/span><a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/services\/foreign-workers\/agricultural.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"42\"><span lang=\"en-CA\">primary agriculture<\/span><\/a><span lang=\"en-CA\">.\u00a0<\/span><span lang=\"en-CA\">\u00a0<\/span><\/p>\n<p>o\u00a0\u00a0\u00a0\u00a0<span lang=\"en-CA\">\u201cDual-intent\u201d LMIA applications in support of permanent residency that are for low-wage positions will be subject to the refusal to process measure announced on\u00a0<a href=\"https:\/\/www.canada.ca\/en\/employment-social-development\/news\/2024\/08\/minister-boissonnault-reducing-the-number-of-temporary-foreign-workers-in-canada.html\" target=\"_blank\" rel=\"noopener noreferrer\" data-auth=\"NotApplicable\" data-linkindex=\"43\">August 26, 2024<\/a>\u00a0(unemployment rate of 6% in a CMA), the cap on the proportion of low-wage positions at a given
